1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Konnect-U LLC (“Konnect-U,” “we,” “us,” or “our”) governing your access to and use of our website at konnect-u.com and our AI-powered voice and chat agent services (collectively, the “Services”).

By accessing or using our Services, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, you must not use our Services.

2. Description of Services

Konnect-U provides AI-powered virtual voice and chat agent solutions for small to mid-sized businesses, including but not limited to:

  • Inbound and outbound AI voice agents
  • AI chat agents for lead qualification and customer support
  • After-hours virtual receptionist services
  • Client recovery and cart recovery automation
  • Solo AI assistant plans

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

3. Subscriptions and Billing

a. Subscription Plans

Our Services are offered on a subscription basis. By subscribing, you authorize us (or our payment processor) to charge your payment method on a recurring basis at the rate associated with your selected plan.

b. Account Email Requirement

When subscribing, you must use the same email address associated with your Konnect-U account. Failure to do so may result in your monthly call and chat minutes not being credited to your account. Konnect-U is not responsible for lost credits due to mismatched email addresses.

c. Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days’ notice before any price change takes effect. Your continued use of the Services after the price change constitutes acceptance of the new price.

d. Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at info@konnect-u.com. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period, except as provided in our Money-Back Guarantee.

4. 14-Day Money-Back Guarantee

New subscribers are eligible for a full refund within 14 days of their initial purchase if they are not satisfied with the Services. To request a refund, contact us at info@konnect-u.com within 14 days of your purchase date. This guarantee applies to first-time purchases only and does not apply to renewals or plan upgrades.

5. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable laws or regulations, including telemarketing and do-not-call laws
  • Harass, abuse, or harm any person
  • Transmit spam, unsolicited communications, or deceptive content
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the integrity or performance of the Services
  • Attempt to gain unauthorized access to any part of the Services
  • Use the Services for any illegal or unauthorized purpose

We reserve the right to suspend or terminate your access to the Services immediately if you violate these Terms.

6. Intellectual Property

The Services and all content, features, and functionality (including but not limited to text, graphics, logos, and software) are owned by Konnect-U LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

7. Compliance with Telecommunications Laws

You are solely responsible for ensuring your use of our AI voice and chat agents complies with all applicable federal, state, and local laws, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and any applicable state telemarketing laws. You represent and warrant that you have obtained all necessary consents from individuals you contact using our Services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KONNECT-U LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Konnect-U LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last Updated” date. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
